PDPA Notice
Issued under Section 7 of the Personal Data Protection Act 2010, as amended.
This Notice is shorter and more direct than the Privacy Policy by design. Section 7 requires a written notice in specific terms; it is not a place for narrative. The Privacy Policy sits alongside it and gives the detail.
Personal Data Protection Notice
Nexagate Sdn Bhd (Company No. [registration number]) is committed to protecting your personal data in accordance with the Personal Data Protection Act 2010.
1. Personal data we process
We process personal data you provide to us, including your name, business contact details, company and job title, the content of your enquiries, and where relevant your employment, educational and certification records. We also process data generated when you use our website.
2. Source
This personal data is collected directly from you, or from your employer, a referrer, publicly available professional sources, or our business partners.
3. Purposes of processing
- Responding to your enquiry and preparing quotations
- Providing and administering the services you or your organisation engage us for
- Delivering Nexa Academy training, assessment and certification
- Processing applications for employment
- Invoicing, payment and financial record-keeping
- Sending service updates, security advisories and marketing, where you have consented
- Complying with legal, regulatory, audit and certification obligations
4. Disclosure
Your personal data may be disclosed to our group companies including PT Nexagate Siber Sekuriti, our service providers and technology partners acting on our instructions, our professional advisers, and regulators, law enforcement or courts where required by law. It may be transferred outside Malaysia in accordance with the PDPA.
5. Obligatory data
The personal data marked as required in our forms is obligatory. If you do not supply it we may be unable to respond to your enquiry, provide the service, enrol you in a programme, or consider your application.
6. Your rights
You have the right to request access to and correction of your personal data, to withdraw your consent, to limit its processing for direct marketing, and to request its portability to another data controller. Requests may be made to our Data Protection Officer at dpo@nexagate.com or +603 2935 9363. A prescribed fee may apply to a data access request, and we may require proof of identity.
7. Retention
We retain personal data only as long as necessary for the purposes above, or as required by law.
8. Consent
By submitting your personal data to us, you consent to its processing as described in this Notice and in our Privacy Policy at nexagate.com/privacy.
You may withdraw your consent at any time by written notice to our Data Protection Officer. Withdrawal does not affect processing carried out before it, and may mean we can no longer provide a service to you.
